| Company Sued After Employee Involved in Car Accident |

IMPORTANT HIGHLIGHTS: OCTOBER 2010, Harris County, Texas — Vickie Darlean Mackey, of Spring, filed suit Monday in the Harris County District Court against S&L Ruiz Painting and its unlicensed employee, Ignacio C. Beristain. The Spring-based painting company is being sued for negligence claiming that one of its unlicensed driver employees struck her car.
Ms. Mackey claims traffic began to slow due to a disabled vehicle that was off the shoulder. The plaintiff stopped, awaiting oncoming traffic to pass. The suit claims that as she waited, Beristain, struck her 2004 Ford Expedition from behind. Beristain was allegedly operating a company vehicle for co-defendant S&L Ruiz at the time of the accident. Mackey says Beristain was not licensed to drive a motor vehicle and claims the company was negligent. The suit also alleges that S&L Ruiz Painting wrongfully entrusted its company vehicle to an unlicensed and incompetent driver. Ms. Mackey is seeking damages to be determined by a jury trial in the 333rd District of the Harris County Court.
