On Duty Miami Police Officer Charged with DUI after Accident

LATEST NEWS: JULY 2011, Miami Beach, Florida—A Miami Beach police officer has been charged with DWI and reckless driving causing serious bodily injury, after severely injuring two people while driving an ATV on the beach.

Two Miami uniformed police officers visited a South Beach hotel club and were allegedly drinking and taking pictures with a group of women. According to a Circuit Court affidavit, Derick Kuilan, and Rolando Gutierrez joined five women who were attending a bachelorette party. The women did not believe the two men were real police officers, since “the behavior of both officers was so unprofessional.”

After leaving the hotel club, Kulian and one of the women mounted an ATV for a ride along the beach. The two witnesses described Kuilan's ATV as “driving fast on the sand”, with no headlights in the pre-dawn hours. The witnesses heard the ATV and only saw it for a few seconds before they heard “a loud impact”. The ATV had struck two people walking on the shore.

The 29 year-old woman remains hospitalized after suffering a broken femur and having her spleen removed. The male victim, also 29, suffered a broken bone that required surgery.

Both Kuilan and Gutierrez have been fired from the Miami Beach Police Department. Kulian was booked into the Miami-Dade County Jail  on four felony counts and has been released on $30,000 bail.
